Director, Writer named for “The Crow” (Reuters)

LOS ANGELES (TheWrap.com) ? A day after the Weinstein Co. and Relativity Media settled their lawsuit over the movie “The Crow,” Relativity on Tuesday said that it has attached a director and writer to the remake.

F. Javier Gutierrez, director of the Spanish-language apocalyptic thriller “Before the Fall,” will direct. He is now filming “The Monkey’s Paw” in Spain.

Jesse Wigutow, who recently rewrote “The Osterman Weekend,” based on the Robert Ludlum novel, for Summit, will write the script.

Relativity says its adaptation of Alex Proyas’ 1994 cult classic will be “a gritty reboot of the iconic character Eric Draven, who returns from the grave as “The Crow” on a mission to avenge his wife’s murder, so that his soul can finally rest.”

The studio hasn’t yet announced a release date or cast.

Edward R. Pressman, who produced the original, is producing along with Jeff Most and Relativity’s CEO, Ryan Kavanaugh.

Relativity co-president Tucker Tooley and Farah Films’ Dan Farah will executive produce. Harvey and Bob Weinstein, of The Weinstein Company, also will executive produce.

The Weinstein Company had sued Relativity, alleging that it had reneged on a deal to allow it to distribute the dark superhero film. On Monday, Relativity and Weinstein announced that they had settled the case and that the companies would partner on the remake.

GPS uncovers possible Southwest quake risk

The U.S. Southwest isn’t particularly known for its seismic activity, but the Rio Grande Rift, a series of faults and basins that runs from central Colorado south through New Mexico, is alive and stretching, new research shows.

Scientists had suspected the rift might be dead, but measurements of its movement varied widely and were riddled with uncertainties. Now, thanks to state-of-the-art GPS technology, geophysicists have found the rift is indeed extending ? just very slowly.

And of course, anytime a large chunk of the Earth’s crust moves, the issue of earthquakes arises.

“There’s certainly potential for earthquakes in this region,” said Anne Sheehan, a seismologist at the University of Colorado at Boulder who co-authored the new study. “They would be very low-probability events but, like all earthquakes, they could have large consequences if they do happen.”

Not dead, but not thriving
Sheehan began studying the region after noticing something odd in the mantle underlying the Rio Grande Rift. Studies had shown that seismic waves move through this part of the mantle very slowly, hinting that it could be quite hot. It could also mean that the overlying continental crust is spreading apart, Sheehan thought.

Using a large network of GPS stations ? nearly 300 sites ? her team monitored the rift’s movement over four years. They found that the rift is in fact spreading very slowly, at a rate of about 0.1 millimeters per year.

“That’s really pretty small,” Sheehan told OurAmazingPlanet. “The rift is not dead, but it’s not really thriving, either.”

More surprisingly, the team found that the spreading isn’t focused at the rift itself, but is spread across a span of more than 370 miles (600 kilometers).

“That wasn’t what we expected, because the deformation at the surface has been along faults that are relatively narrow,” said Henry Berglund, a geophysicist at UNAVCO who led the study. “Instead, we observed the deformation is likely much broader than that ? at least the width of the state of New Mexico.”

A real earthquake risk?
As for earthquake risks, Berglund explained, “It’s not a predictive tool, but it does tell us that, if the deformation is broader, maybe we’re more likely to have earthquakes in more places than we previously expected.?

There was a magnitude-5.3 quake near Trinidad, Colo., last August, and a larger earthquake with an estimated magnitude of 6.6 in north-central Colorado in 1882. A magnitude-5.5 quake shook Dulce, N.M., in 1966. Future quakes in the region could also fall in the magnitude-5 or -6 range, but likely not much higher, Sheehan said.

“We can’t use this to say we expect to see a big earthquake anywhere in the region,” Sheehan cautioned. “But a more worrisome aspect is that we don’t really expect earthquakes here, so our building codes aren’t as strict as they are in, say, California.”

The team’s findings appear in the January issue of the journal Geology.

Staff Sgt. Frank Wuterich led the Marine squad in 2005 that killed 24 Iraqis in the town of Haditha after a roadside bomb exploded near a Marine convoy, killing one Marine and wounding two others.

Wuterich’s plea Monday interrupted his trial at Camp Pendleton before a jury of all combat Marines who served in Iraq.

Wuterich faces a maximum of three months confinement, two-thirds forfeiture of pay and a rank demotion to private when he’s sentenced, likely on Tuesday.

The issue at the court martial was whether Wuterich reacted appropriately as a Marine squad leader in protecting his troops in the midst of a chaotic war or disregarded combat rules and ordered his men to shoot and blast indiscriminately at Iraqi civilians. Wuterich was charged with nine counts of manslaughter, among other charges, and is one of eight Marines initially charged. None has been convicted.

Prosecutors said he lost control after seeing the body of his friend blown apart by the bomb and led his men on a rampage in which they stormed two nearby homes, blasting their way in with gunfire and grenades. Among the dead were women, children and elderly people, including a man in a wheelchair.

Wuterich’s former squad members testified that they did not take any gunfire during the 45-minute raid on the homes nor find any weapons, but several squad members testified that they do not believe they did anything wrong, fearing insurgents were inside hiding.

The prosecution was further hurt by the testimony of Wuterich’s former platoon commander who said the squad was justified in its actions because house was declared “hostile,” and from what he understood of the rules of combat at the time that meant any use of force was allowed and Marines did not need to positively identify their targets.

Wuterich has said he regretted the loss of civilian lives but believed he was operating within military combat rules.

After Haditha, Marines commanders ordered troops to try and distinguish between civilians and combatants.

The killings in Haditha on Nov. 19, 2005, still fuel anger in Iraq and were the primary reason behind demands that U.S. troops not be given immunity from their court system. It is considered among the war’s defining moments, further tainting America’s reputation when it was already at a low point after the release of photos of prisoner abuse by U.S. soldiers at Abu Ghraib prison.

The trial was delayed for years by pre-trial wrangling between the defense and prosecution, including over whether the military could use unaired footage from an interview Wuterich gave in 2007 to CBS “60 Minutes.” Prosecutors eventually won the right to view the footage

Six squad members have had charges dropped or dismissed, including some in exchange for testifying at the trial. One was acquitted.

Why Did Chelsea Handler Dump 50 Cent?


On Howard Stern’s show Monday, Chelsea Handler was surprisingly (or maybe not that surprisingly) candid about her ill-fated relationship with 50 Cent.

She wasted no time confirming that this rumored couple was in fact a couple, and revealing what her friends thought and why they ultimately split up.

“He’s actually a lot different than you would think,” she said. “He’s really sweet. I thought it was kind of amusing that I would even be with 50 Cent.”

“My friends all loved him, my friends fell in love with him,” she said, including Reese Witherspoon and Jennifer Aniston, who were as surprised as us.

“They loved that I was dating him. They were like, ‘Chelsea, come on.’ They were both laughing really hard at it – everyone was – but they loved him.”

So what went wrong? “We dated for a couple months and then we had a falling out,” she said. “One of his ex-girlfriends was coming onto my show.”

She did not say who, but that was apparently the end of it. Why?

According to Handler, Fiddy wanted to give her a heads up that his ex still had feelings for him, but Chelsea had other things – her job – on her mind.

“I was like, at my job,” she said. “It was just so juvenile, I couldn’t get past that. I was at work. I hung up and I’ve never spoken to him again.”

But that’s not to say there are any hard feelings, at least not on her part: “I do think he’s a really nice guy and I think he’s smart in a certain way.”

Considering it’s Chelsea Handler we’re talking about, that’s as nice of a compliment as anyone, let alone an ex of hers, could possibly expect.

We just hope 50 doesn’t read this story. He’s already despondent of late, we don’t need him firing off anymore introspective suicidal-sounding tweets.

(AP) ? Unwilling to wait for an evening debate, Republican presidential rivals Mitt Romney and Newt Gingrich got a head start on the squabbling on Monday in a campaign turning more caustic by the day.

Romney, trounced by Gingrich in last weekend’s weekend South Carolina primary, began airing a harshly critical new campaign ad and said the former House speaker had engaged in “potentially wrongful activity” with the consulting work he did after leaving Congress in the late 1990s.

Gingrich retorted that Romney was a candidate who was campaigning on openness yet “has released none of his business records.”

He followed up two hours before the debate by arranging the release of a contract his former consulting firm had with the Federal Home Loan Mortgage Corp. for a retainer of $25,000 per month in 2006, or a total for the year of $300,000. The agreement called for “consulting and related services.”

Despite Romney’s attempts to call Gingrich a lobbyist, the contract makes no mention of lobbying.

Aside from Romney and Gingrich, former Pennsylvania Sen. Rick Santorum and Texas Rep. Ron Paul had spots on the debate stage for the first of two encounters scheduled before the Jan. 31 Florida primary.

Increasingly, though, the race for the nomination appeared to be a two-way competition between the former Massachusetts governor and the one-time speaker of the House.

After relying on allies to make most of the attacks on his rivals earlier in the campaign, Romney unleashed a commercial that went straight at Gingrich.

“While Florida families lost everything in the housing crisis, Newt Gingrich cashed in,” the TV ad says, noting that the former speaker made more than $1.6 million working for Freddie Mac. “Gingrich resigned from Congress in disgrace and then cashed in as a D.C. insider.”

Gingrich never registered as a lobbyist, but said he was a consultant for Freddie Mac, the federally backed mortgage company that played a significant role in the housing crisis.

It remains to be seen if Romney can effectively use his newly aggressive stance on the debate stage, a forum in which Gingrich has excelled so far. Underfunded and overmatched by Romney’s massive ground game across the country, Gingrich has relied upon strong debate performances to build support.

It appears Romney has brought in outside help to improve his debate technique.

Veteran debate coach Brett O’Donnell was spotted at a Romney campaign stop on Monday. He previously advised President George W. Bush and GOP nominee John McCain and was a senior adviser and speech writer for Michele Bachmann’s abbreviated campaign.

Gingrich showed no signs of backing down.

During an appearance on ABC’s “Good Morning America,” he referred to Romney as “somebody who has released none of his business records, who has decided to make a stand on transparency without being transparent.” After initially balking, Romney is set to release personal tax records on Tuesday.

Cruise ship captain: I was told to perform fatal maneuver

Divers find the body of a woman in the ship as pressure grows to speed up the salvage operation. NBC’s Duncan Golestani reports.

Updated at 4:00 p.m. ET: GIGLIO, Italy –? The operators of the Costa Concordia faced questions over their share of the blame for the shipwreck, as divers recovered another body from the stricken liner Sunday, bringing the known death toll to 13.

Captain Francesco Schettino is accused of steering the cruise ship too close to shore while performing a maneuver known as a “salute” in which liners draw up very close to land to make a display.

Schettino, who is charged with multiple manslaughter and with abandoning ship before the evacuation of 4,200 passengers and crew was complete, has told prosecutors he had been instructed to perform the maneuver by operator Costa Cruises.

Prosecutors say he steered the massive ship within 150 meters of the Tuscan island of Giglio, where it struck a rock that tore a large gash in its hull, letting water flood in and causing the 114,500-ton ship to capsize.

It is now lying on its side on an undersea ledge, half-submerged and posing a growing environmental threat with the risk that it could slide into deeper waters.

As the days have passed, there have been growing questions about the ultimate responsibility for the accident, which Costa Cruises has blamed on “unfortunate human error” and placed firmly on the shoulders of the captain. It has suspended Schettino and will not be paying his legal fees.

Costa chief executive Pier Luigi Foschi has said that ships sometimes engage in “tourist navigation” in which they approach the coast but that this is only done under safe conditions and he was not aware of any riskier approaches so close to the shore.

Costa is a unit of Carnival Corp, the world’s largest cruise line operator.

According to transcripts of his hearing with investigators leaked to Italian newspapers, Schettino told magistrates Costa had insisted on the maneuver to please passengers and attract publicity.

“It was planned, we were supposed to have done it a week earlier but it was not possible because of bad weather,” Schettino said, according to the Corriere della Sera daily.

“They insisted. They said: ‘We do tourist navigation, we have to be seen, get publicity and greet the island’.”

He said he had performed similar maneuvers regularly over the past four months on the Costa Concordia and on other ships in the Costa fleet along the Italian coast line which is dotted with small islands that are popular with tourists.

“But we do it every time we do the Sorrento coast, Capri, we do it everywhere,” he said.

Foschi, who visited Giglio Sunday, declined to respond to Schettino’s latest comments.

“As an investigation by magistrates is currently underway, we cannot give out any information,” he said.

Seemingly minute shifts in the position of the cruise ship that partially sank in an Italian port is hampering the underwater search for 21 passengers and crew missing for more than a week. NBC’s Michelle Kosinki reports from Giglio, Italy.

Identifying victims
As the search continued into a ninth day, divers found the body of a woman on a submerged deck near the bow of the vessel, bringing the total number of known dead to 13, only eight of whom have been identified.

Unregistered passengers might have been aboard the stricken cruise liner that capsized off this Tuscan island, a top rescue official said Sunday, raising the possibility that the number of missing might be higher than the 20 previously announced.

Civil protection official Francesca Maffini told reporters the victim found on Sunday was wearing a life vest and was found in the rear of a submerged portion of a ship by a team of fire department divers. The unidentified body was being removed from the ship.

Earlier, Italian authorities raised the possibility that the real number of the missing was unknown because some unregistered passengers might have been aboard. As of Sunday, 19 people are listed as missing, but that number could be higher.

“There could have been X persons who we don’t know about who were inside, who were clandestine” passengers aboard the ship, Franco Gabrielli, the national civil protection official in charge of the rescue effort, told reporters at a briefing on the island of Giglio.

Gabrielli said that relatives of a Hungarian woman have told Italian authorities that she had telephoned them from aboard the ship and that they haven’t heard from her since the accident. He said it was possible that a woman’s body pulled from the wreckage by divers on Saturday might be that of the unregistered passenger.

But in addition to the body recovered on Sunday, the body found on Saturday and those of three men found a few days earlier, have yet to be identified, because the corpses were badly decomposed after so much time in the water. Gabrielli said they have identified the other eight bodies: four French, an Italian, a Hungarian, a German and a Spanish national.

Until Sunday, authorities had said that 20 people are still missing.

The Costa Concordia ran aground Jan. 13 off the coast of Italy, resulting in the evacuation of thousands of passengers as the ship began heavily listing.

Meanwhile, police divers, carrying out orders from prosecutors investigating Schettino for suspected manslaughter and abandoning the ship, swam through the cold, dark waters to reach his cabin. State TV and the Italian news agency ANSA reported that the divers located and remove his safe and two suitcases. His passport and several documents were also pulled out, state media said.

Searchers inspecting the bridge Saturday also found a hard disk containing data of the voyage, Sky TG24 TV reported.

Italian newspapers have also published photographs of the Costa Concordia apparently performing the “salute” close to other ports including Syracuse in Sicily and the island of Procida, which is near Naples and Schettino’s hometown of Meta di Sorrento.

Schettino said the fatal maneuver was originally intended to bring the ship half a mile from the shore, “but then we brought it to 0.28″ (of a nautical mile), he said.

Investigators have said the actual point of impact was much closer to the shore but establishing the exact sequence of events could be complicated by problems with the recording equipment used to track the ship’s progress.

Schettino said the black box on board had been broken for two weeks and he had asked for it to be repaired, in vain.

In the hearing, Schettino insisted he had informed Costa’s headquarters of the accident straight away and his line of conduct had been approved by the company’s marine operations director throughout a series of phone conversations.

As soon as he realized the scale of the damage, he called Roberto Ferrarini, marine operations director for Costa Cruises.

“I told him: I’ve got myself into a mess, there was contact with the seabed. I am telling you the truth, we passed under Giglio and there was an impact,” Schettino said.

“I can’t remember how many times I called him in the following hour and 15 minutes. In any case, I am certain that I informed Ferrarini about everything in real time,” he said, adding he had asked the company to send tug boats and helicopters.

He acknowledged, however, not raising the alarm with the coastguard promptly and delaying the evacuation order.

“You can’t evacuate people on lifeboats and then, if the ship doesn’t sink, say it was a joke. I don’t want to create panic and have people die for nothing,” he said.

Costa Cruises Chief Executive Pier Luigi Foschi says Schettino delayed issuing the SOS and evacuation orders and gave false information to the company headquarters.

“Personally, I think he wasn’t honest with us,” Foschi told Corriere della Sera Friday. He said the first phone conversation between Schettino and Ferrarini took place 20 minutes after the ship hit the rock.

As the death toll rises from the Costa Concordia, the ship’s captain is fighting back against allegations that he abandoned his post. NBC’s Michelle Kosinski reports.

Documents from his hearing with a judge say he had shown “incredible carelessness” and a “total inability to manage the successive phases of the emergency.”

Taped conversations show ship’s officers told coastguards who were alerted by passengers that the vessel had only had a power cut, even after those on board donned lifevests.

According to transcripts of his questioning by prosecutors leaked to Italian media, he said that immediately after hitting the rock he sent two of his officers to the engine room to check on the state of the vessel.

Holding out hope
Meanwhile, family members of a couple from the state of Minnesota still missing after last week’s cruise ship wreck say they’ve been meeting in Italy with rescue workers.

In an email statement sent Saturday night to news organizations, relatives of Jerry and Barbara Heil say the captain in charge of the operation indicated he wasn’t ready to give up hope that the missing can be found.

The family members say they and relatives of others missing from the Costa Concordia accident were taken out near the ship and allowed to place flowers in the water honoring their loved ones. They say the workers stopped what they were doing and saluted during the tribute.

The Heil family says it’s grateful for the efforts from the workers trying to find the missing.

The search had been halted for several hours early Sunday, after instrument readings indicated that the Concordia has shifted a bit on its precarious perch on a seabed just outside Giglio’s port. A few yards away, the sea bottom drops off suddenly, by some 65-100 feet, and if the Concordia should abruptly roll off its ledge, rescuers could be trapped inside.

The effort to find survivors and bodies has postponed an operation to remove heavy fuel in the Concordia’s tanks; specialized equipment has been standing by for days.

Light fuel, apparently from machinery aboard the capsized ship, was spotted in nearby waters, authorities said Saturday.

Environment experts have warned that contamination of the pristine waters around Giglio, which is in the middle of a national marine park, is already under way and it is imperative to start recovering the fuel oil as soon as possible.

Man pleads no contest to stalking Halle Berry (AP)

LOS ANGELES ? A man accused of scaling the fence of Halle Berry’s house will remain in jail after pleading no contest to stalking the Oscar-winning actress.

Deputy District Attorney Wendy Segall says Richard A. Franco was sentenced to serve 386 days in county jail Thursday, but he has already served half the term.

The 28-year-old was also placed on five years’ probation, a year of psychological counseling and ordered to stay away from the actress for the next decade.

Franco was arrested outside Berry’s home in July after repeatedly coming onto her property. In one instance, the actress stated in a sworn declaration that Franco attempted to enter her kitchen, but she was able to lock the door before he got inside.

A burglary charge filed against Franco was dropped.

Editorial: Don’t call it an ultrabook

Every year at CES, the tech-watching masses engage in a bit of trendspotting — an attempt to identify the one or two big themes of the show that may or may not come to define the year in technology. Some years those are easy to spot (tablets and 3D TV were two big ones recently), and other times they involve a bit of guesswork. This year, one of the most oft-cited trends is the “ultrabook.” Judging from the companies’ announcements at the show and some of the coverage they’ve received, you might think that’s a new sort of device or a radically new type of laptop. But, really, they’re just laptops. Small, thin laptops — but laptops.

It’s actually Ultrabook, with a capital “U,” and a (TM). The name is a wholly-owned creation of Intel, and the hype you’ve seen for them at CES is only just the beginning. Intel is reportedly planning its biggest advertising push in eight years to promote Ultrabooks, and it’s clearly already done a decent job of bringing hardware manufacturers on board the bandwagon. How many new “laptop” announcements do you remember from CES?
